USER AGREEMENT (TERMS OF USE) This User Agreement (the "Agreement") is established between Ofi Teknoloji A.Ş. (the "Company")—located at Pınarbaşı Mah. Hürriyet Cad. Antalya Teknokent Uluğbey AR-GE 2 Binası No: 3 A İç Kapı No: B190, Konyaaltı / Antalya—and the person using the UmrahAI application (the "Application") (the "User"), upon the User creating an account or commencing use of the Application.
Account and Age An account is created using a phone number and a one-time verification code. The account holder must be 18 years of age or older. Individuals under the age of 18 cannot open their own accounts; they are registered as child accounts subject to parental/guardian consent, and no licenses are assigned to child accounts. The User acknowledges that the information provided is accurate and agrees not to share their account with third parties.
Scope of Service The free tier of the Application includes: Qibla direction, prayer times, tasbih (digital prayer beads), an offline map, and sample content. Access to paid features is provided either via a license assigned to you by your agency or through in-app purchases, to the extent offered. Paid access provides full access subject to fair use principles; fair use limits apply to specific features, and current limits are announced within the Application.
Agency-Linked Licenses If your license has been assigned by your agency, the start of the license is contingent upon your agency's tour operations; the license automatically terminates at the end of the third day following the tour's conclusion or at the end of the forty-fifth day from the start date—whichever occurs first. The remaining duration is displayed within the Application. The tour contract between you and your agency is independent of this Agreement; the Company is not a party to your agency's commitments.
Rules of Use The User may not use the Application for unlawful purposes, enter or share the personal data of others without authorization, attempt to bypass security measures, reverse-engineer the software, sell or transfer access rights to third parties, or use the group voice communication feature to disseminate offensive or unlawful content. In the event of a violation, the Company may suspend or terminate the account.
Religious Content and Artificial Intelligence Content within the Application and AI-generated responses are for informational purposes only. The UmrahAI artificial intelligence assistant is intended for informational purposes and does not constitute an authority for issuing religious rulings (fatwas). Artificial intelligence may make errors; please verify information regarding important matters. Detailed terms are set forth in the Artificial Intelligence Terms of Use.
Intellectual Property All rights regarding the Application, software, design, content, and trademarks belong to the Company or its licensors. The User consents to the processing of questions and content submitted to the Application for the purpose of providing the service and ensuring security; rights to such content remain with the User.
Third-Party Services The Application operates in conjunction with third-party services such as app stores, mapping services, and the like. The terms of these services apply; the Company cannot be held liable for interruptions or errors associated with third-party services.
Limitation of Liability The Application is provided on an "as-is" basis; there is no guarantee that it will operate without interruption or error. To the maximum extent permitted by law, the Company’s liability arising from this Agreement is limited to direct damages and the amount paid by the User to the Company in the preceding twelve months, excluding cases of willful misconduct or gross negligence and damages to life, health, or bodily integrity. Consumers' mandatory rights arising from applicable legislation are reserved.
Suspension, Termination, and Account Deletion The User may delete their account at any time via the Application or at https://umrahai.ai/hesap-silme. The Company may suspend the account or terminate the Agreement in the event of a material breach of this Agreement; vested rights regarding paid access are reserved.
Amendments The Company may update this Agreement. Material changes will be announced within the Application and notified with reasonable advance notice; the User’s continued use of the Application constitutes acceptance of the updated terms. Users who do not accept the changes may discontinue use and delete their accounts.
Governing Law and Disputes This Agreement is governed by the laws of the Republic of Turkey. Users qualifying as consumers may apply to Consumer Arbitration Committees and Consumer Courts in their place of residence or the place where the transaction occurred.
